Legal notice
These Terms and Conditions explain how products from Still & Faithful Co. may be purchased, downloaded, and used. By purchasing, downloading, accessing, or using any product from Still & Faithful Co., you confirm that you have read, understood, and agreed to these terms. If you do not agree, you may not purchase, download, access, or use our products.
A product listing may include additional or more restrictive license terms. Those listing-specific terms become part of this agreement. If a listing-specific term conflicts with this document, the more restrictive term applies unless Still & Faithful Co. gives written permission otherwise.
1 Digital Products
Still & Faithful Co. sells digital products, which may include:
● PNG designs
● Clipart
● Seamless patterns and digital papers
● Alphabet and number sets
● Commercial use design resources
● Classes, collaborations, and digital bundles
No physical product will be shipped unless the product listing clearly states otherwise.
2 Copyright and Ownership
All artwork, designs, graphics, clipart, patterns, files, previews, photographs, branding, and other content sold or provided by Still & Faithful Co. remain the intellectual property of Still & Faithful Co. and, when applicable, the original credited creator.
A purchase grants a limited license to use the product under these terms. It does not transfer copyright, ownership, authorship, or exclusive rights to the purchaser.
You may not claim any Still & Faithful Co. product or element as your original artwork. When you create a permitted finished composition, you may claim only the original elements that you personally added. You may not claim ownership of the purchased artwork contained within that composition.
3 General License
Unless a listing states otherwise, each purchase includes a limited, nonexclusive, nontransferable license for one individual or one business.
Under this license, you may:
● Create finished physical products for personal use or commercial sale.
● Use completed designs on shirts, tumblers, cups, stickers, signs, transfers, stationery, blankets, and similar finished physical products.
● Hire a printer or manufacturer to produce finished products solely for your business, provided the files are protected and are not reused, sold, shared, or retained for any other purpose.
● Use qualifying clipart to create a new flattened digital design only when every requirement in Section 4 is satisfied.
Each individual or business using the files must purchase its own license. Group purchasing, account sharing, file sharing, and transferring a license to another person or business are prohibited.
4 Clipart License and Requirements
Clipart purchased from Still & Faithful Co. may be used to create new physical or flattened digital end products only when every requirement in this section is followed.
Clipart Color Changes and Other Restrictions
Clipart colors may be changed to fit a qualifying finished end design. Recolored clipart may not be sold, shared, or distributed as standalone clipart or as a clipart set. Except for permitted color changes, you may not:
● Crop, erase, redraw, trace, or remove any part of the artwork.
● Add details directly to the artwork or edit details within it.
● Apply filters, textures, overlays, or effects to the artwork, except for color adjustments permitted for a qualifying finished end design.
● Stretch, distort, warp, flip, reshape, or separate the artwork's components.
● Use the clipart to create outlines, stamps, brushes, SVG files, cut files, or other design resources.
You may resize the clipart proportionally, position it within your composition, and change its colors to fit the finished end design. Resizing must not stretch, distort, crop, or otherwise change the shape or details of the original artwork.
Additional Elements or Wording Required
The clipart must be combined with additional visible design elements and/or meaningful wording. It may not be used or sold by itself.
The added elements must be intentionally incorporated into the finished composition. Placing the clipart on a plain background or adding only a border, texture, tiny phrase, name, or unrelated decoration does not create a qualifying design.
Finished Clipart Design Requirements
The finished product must be a new and complete composition. The original clipart may not be easily removed, isolated, or extracted.
Any qualifying digital end design must:
● Be sold only as a flattened PNG or JPG file.
● Contain additional design elements and/or meaningful wording.
● Preserve the original clipart except for color changes permitted for a qualifying finished end design.
● Contain no editable layers, source files, or separately accessible elements.
● Prevent customers from accessing or extracting the original clipart.
● Include license terms limiting the customer's use to finished physical products.
A completed design may not be sold as clipart, a design resource, an element bundle, an editable template, an SVG, a layered file, or any other product that competes with the original artwork.
Adding words or elements does not make a design compliant unless all requirements in this section are met. Changing colors does not permit the artwork to be sold, shared, or distributed as clipart.
5 Completed PNG Design Terms
Completed PNG designs may be used on finished physical products for personal use or commercial sale.
You may not:
● Resell, share, gift, trade, or redistribute the digital file.
● Sell the design as another PNG, SVG, JPG, PDF, or digital download.
● Trace, redraw, copy, recreate, or modify the design for resale.
● Remove elements from the design and sell or distribute them separately.
● Include the design in a digital bundle, freebie, or giveaway.
● Upload the file to a website, app, or platform where another person can download, customize, or access it.
6 Seamless Patterns and Digital Papers
Seamless patterns and digital papers may be used to create finished physical products. They may not be:
● Sold, shared, gifted, or distributed as digital patterns or backgrounds.
● Repackaged into digital paper, texture, or background bundles.
● Recolored, modified, or resold as new seamless files.
● Uploaded to print-on-demand or fabric-printing marketplaces where the original file can be purchased, downloaded, or accessed by others.
A finished physical product may not be designed or marketed as a method for customers to obtain or extract the original pattern.
7 Mockup Terms
Purchased mockups may be used to display and advertise your own finished designs or products. A completed mockup image must contain your design and must not allow the blank mockup to be easily extracted.
You may not resell, share, gift, trade, or redistribute a blank mockup. Mockup files may not be included in bundles, templates, or digital product listings.
8 Prohibited Uses
Unless Still & Faithful Co. gives written permission, no product may be:
● Shared with friends, family members, employees, customers, design groups, or other businesses.
● Resold, gifted, traded, or redistributed in its original form.
● Modified and resold except for a qualifying clipart composition that fully complies with Section 4.
● Included in dump groups, bundles, or freebie groups.
● Uploaded to Canva, Corjl, Templett, Creative Fabrica, Design Bundles, Creative Market, or a similar platform as an editable or downloadable asset.
● Used to register or claim copyright or trademark ownership over the original artwork.
● Copied, traced, recreated, reverse engineered, or used to imitate the original artwork.
● Uploaded to an artificial intelligence, machine learning, image generation, model training, or dataset system.
● Used to create or sell NFTs, cryptocurrency-related products, or blockchain assets.
Giving credit to Still & Faithful Co. does not replace compliance with these terms.
9 Print on Demand and Third Party Production
You may use a third-party printer or production company to manufacture finished products solely for your business. You are responsible for ensuring that the company protects the files and does not reuse, retain, sell, share, distribute, or make them available to another person.
Uploading files to a public print-on-demand marketplace where another seller or customer can access, purchase, download, extract, or customize the original design is prohibited.
10 Digital Delivery and Customer Responsibility
Customers are responsible for providing an accurate email address, maintaining access to their account, downloading purchases, backing up files, and confirming that their devices and software support the purchased file types.
Still & Faithful Co. is not responsible for files lost because of device failure, deleted accounts, expired links, customer error, incompatible software, or a customer's failure to download and back up a purchase.
11 Refunds Exchanges and Cancellations
Because digital products provide immediate access, all sales are final unless applicable law requires otherwise.
Refunds, returns, cancellations, and exchanges will not be provided because a customer:
● Changed their mind.
● Purchased the wrong product.
● Did not read the listing or license terms.
● Does not have the software, equipment, or knowledge needed to use the file.
● Downloaded the product and later decided it was unsuitable.
● Experienced color differences caused by screens, printers, ink, materials, or equipment.
If a file is corrupted, incomplete, or materially different from its listing, contact Still & Faithful Co. so the issue can be reviewed and, when appropriate, corrected or replaced.
12 Payments and Payment Disputes
Payment must be completed before files are provided. If a payment is reversed, disputed, or charged back, the related license and access may be suspended while the matter is reviewed.
Customers should contact Still & Faithful Co. about an order problem before filing a payment dispute so there is an opportunity to review and resolve the issue. Fraudulent payment disputes may result in termination of licenses, removal from associated business groups, loss of access, refusal of future service, and any remedies available by law.
13 Product Variations and Testing
Colors may appear different across screens, printers, inks, materials, and production methods. Still & Faithful Co. cannot guarantee that a printed color will exactly match a digital preview.
Customers are responsible for checking file dimensions, testing files, and confirming print quality before beginning full production.
14 Third Party Intellectual Property
Customers are responsible for ensuring that their finished products and added content comply with applicable copyright, trademark, publicity, and other intellectual property laws.
15 License Violations and Termination
A violation of these terms immediately terminates the applicable license without refund. After termination, you must stop using the affected products and remove all prohibited listings, downloads, and products from sale.
Still & Faithful Co. may revoke access, refuse future purchases, remove an individual from associated groups, issue takedown notices, seek compensation, and pursue other remedies available by law.
16 Disclaimer and Limitation of Liability
Products are provided as is. Still & Faithful Co. does not guarantee that a product will meet every customer's personal, technical, production, or commercial requirements.
To the fullest extent permitted by law, Still & Faithful Co. will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the purchase, download, or use of a product. Any liability connected with a purchase will not exceed the amount paid for the product giving rise to the claim.
17 Governing Law
These Terms and Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any legal proceeding must be brought in a court with proper jurisdiction in Texas unless applicable law requires otherwise.
18 Changes to These Terms
Still & Faithful Co. may update these Terms and Conditions when needed. Unless applicable law or a written agreement requires otherwise, the terms in effect on the purchase date govern that purchase. Updated terms apply to future purchases and future access after their effective date.
